These Terms explain the basic rules that apply when you request or use MVX Ride. They are designed to sit alongside our Privacy First approach and the information shown to you in the app.
1. Agreement to these Terms
These Terms of Use govern access to and use of MVX Ride, RideMVX.ca and related rider services provided by Moovyme Inc. By requesting or using an MVX service, you agree to these Terms and acknowledge the MVX Ride Privacy Policy.
If you do not agree, do not use the service.
2. Eligibility and device responsibility
You must be legally capable of entering into these Terms or use MVX through a person who is authorized to arrange the service on your behalf. You are responsible for maintaining control of your device and for the accuracy of information submitted through MVX.
3. Ride requests and service
MVX allows riders to request transportation, review available ride categories and trip information, and submit a ride request. A request is subject to vehicle and Transportation Partner availability and does not guarantee that a ride can be fulfilled until the service confirms the applicable ride/assignment.
You are responsible for providing accurate pickup, destination and contact information and for being ready at the agreed pickup location.
4. Booking a ride for someone else
You may use eligible MVX features to arrange a ride for another passenger. You must have appropriate authority or permission to provide that passenger's information and arrange the ride. You are responsible for ensuring that relevant passenger, pickup and contact information is accurate.
The passenger must comply with applicable rider conduct and safety requirements during the journey.
5. Fares, pricing and payment
MVX displays trip-fare information in the ride flow before confirmation. Pricing may depend on factors such as route, distance, vehicle category, applicable taxes, fees and the pricing policy in effect for the requested service.
MVX pricing may be changed prospectively as pricing policies evolve. The fare presented for a specific ride at confirmation governs that request, subject to corrections for material errors, changes requested by the rider, waiting, stops or other circumstances disclosed in the service where applicable.
Payment is processed through supported payment infrastructure, including Apple Pay where available. You authorize the applicable payment for rides and charges you confirm through the service.
6. Cancellations, changes and refunds
Cancellation, change, waiting and refund rules may vary by service, ride stage or circumstances and will be communicated through the applicable MVX experience or support process. Moovyme may review exceptional situations, duplicate charges, service failures or payment disputes on a case-by-case basis.
7. Transportation Partners
MVX uses professional Transportation Partners and driver infrastructure to fulfill rides. Transportation Partners are expected to satisfy applicable onboarding, qualification and operational requirements established for the services they provide.
Vehicle category, capacity and presentation may vary within the category selected, subject to availability and applicable service standards.
8. Rider conduct
Riders and passengers must treat Transportation Partners, vehicles and other persons respectfully and lawfully. You must not use MVX for unlawful activity, threaten or harass others, damage a vehicle, interfere with safe vehicle operation, misuse the platform, attempt fraud or provide materially false ride information.
Reasonable cleaning, damage or other charges may apply where permitted and appropriately documented.
9. Safety and Support
MVX Ride includes a dedicated Safety & Support section within the app to help riders access important safety information and support during their MVX experience.
The Safety & Support section provides riders with:
- Emergency — Call 911: Direct access to call 911 when immediate emergency assistance is required.
- Contact MVX Support: Access to MVX Support for assistance relating to a ride or the MVX service.
- Confirm Your Driver and Vehicle: Riders should confirm the driver name, vehicle description, and licence plate displayed in MVX before entering the vehicle.
- Ride Safety Guidance: Riders should follow applicable laws and reasonable safety instructions, use seat belts, and use legally required child-restraint systems where applicable.
MVX is a transportation technology and ride service and is not an emergency service. In an emergency, riders should call 911 or the appropriate local emergency service. The Safety & Support features within MVX are intended to provide convenient access to safety information and support and are not a substitute for emergency services.
MVX is also not a substitute for specialized medical transportation, emergency medical transportation, or services requiring clinical supervision or specialized accessibility equipment unless MVX expressly identifies a particular service as providing those capabilities.
10. Intellectual property
MVX, Moovyme, related product names, software, interfaces, designs, content and technology are owned by or licensed to Moovyme Inc. You may use the service for its intended personal transportation purposes but may not copy, reverse engineer, scrape, interfere with, resell or exploit the service except as permitted by law or written agreement.
11. Availability and service changes
Moovyme may modify, improve, suspend or discontinue features, ride categories, geographic availability or other aspects of MVX. Service can be affected by vehicle supply, traffic, weather, communications networks, mapping services, payment providers and other circumstances beyond Moovyme's direct control.
12. Disclaimers and limitation of liability
To the extent permitted by applicable law, MVX is provided subject to the availability and operation of the underlying transportation and technology services. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded under applicable consumer-protection or other law.
Any limitation of liability, indemnity or exclusion intended to apply to the service should be interpreted only to the extent permitted by applicable law. This section should be reviewed by qualified Canadian counsel before relying on it for material legal risk allocation.
13. Suspension or restriction
Moovyme may restrict access to MVX where reasonably necessary to address fraud, misuse, safety concerns, unlawful conduct, payment issues, security risks or material violations of these Terms. Where appropriate, Moovyme may investigate and restore access after the underlying issue is resolved.
14. Governing law
These Terms are intended to be governed by the laws of the Province of Ontario and the applicable federal laws of Canada, subject to any mandatory consumer or other legal rights that apply to a user based on the circumstances of the service.
15. Changes and contact
Moovyme may update these Terms as MVX evolves. The effective date at the top identifies the current published version. Material changes may also be communicated through the website, app or another appropriate channel.
Questions about these Terms may be directed to legal@moovyme.ca. Privacy questions may be directed to privacy@moovyme.ca.
Legal review
These Terms provide a clear operational baseline for MVX riders. Before relying on them as final legal terms—particularly cancellation charges, liability allocation, dispute procedures and consumer-law provisions—Moovyme should have qualified Canadian counsel review them against the production service and applicable Ontario/Canadian law.
